When you arrive in the U.S., CBP officers at the airport decide whether to admit you. Even if you have a valid visa or ESTA, entry is not guaranteed.
Common scenarios include:
-
Secondary Inspection
You are taken aside for additional questioning about your visa, travel history, or background. This can last hours. -
Deferred Inspection
CBP asks you to return with additional documents at a later date. -
Detention
You may be held in a CBP facility for hours or overnight while they investigate. -
Visa Cancellation (22CFR 41.122)
Your visa may be revoked if CBP believes you misrepresented something or violated a visa condition. -
Expedited Removal
You can be summarily deported on the spot under INA § 235(b)(1) or found inadmissible under INA § 212(a). -
5-Year, 10-Year, or Permanent Ban
Depending on the grounds, you may be barred from returning unless you get a waiver.
